GENERAL TERMS AND CONDITIONS OF SALE
The present general terms and conditions apply to the following:

The company Rivecour SAS (Limited Liability Company), whose headquarters are at 6 rue Seveste, 75018 Paris, France, registered in France at the RCS in Paris with the number 821 435 658, editor and owner of the website www.rivecour.com, hosted by OVH.

The following: “Rivecour”
And:
All individuals, be they businesses or private individuals purchasing a product on the website www.rivecour.com
The following: “The Client”


Article 1

The present contract is an online sales contract subject to conditional acceptance by Rivecour and composed according to current French legislation. The object of this present contract is the sale of products featured on the website www.rivecour.com.
The contract will only be formed between the Client and Rivecour when the Client has received confirmation of receipt of the details of the order made on the website www.rivecour.com. Contractual information is presented in French and in English and the products featured for sale conform to French legislation of 1st September 2013.

Article 2

The validation of the order by the Client means they will have accepted the General Terms and Conditions of Sale. The Client commits to paying the entire sum of products ordered as soon as the order has been validated. As the sales contract has an obligation of means on behalf of the seller, Rivecour commits to assigning the items ordered to the delivery services within the time limit stipulated at the end of the contract. Rivecour does however reserve the right to cancel an order were there to have been a dispute with a Client’s previous payment.

Article 3

We strive to describe and present the products on our site www.rivecour.com as precisely as possible. However, if errors or omissions have occurred with regards to their presentation, Rivecour cannot take responsibility. Every photo which represents our products has been chosen with utmost attention and tries to reflect them accurately. The photos do not however fall under contractual agreement and therefore are of indicative nature only.

Article 4

The prices of all our products are indicated in Euros (€), All Taxes Included, excluding handling and shipping costs which are the responsibility of the Client’s (excluding specific promotional operations). These prices are guaranteed, unless there has been a typographical or printing error. However, Rivecour reserves the right to modify prices at any time, without prior notice and without any possible compensation. If prices have been modified, the items will be invoiced according to the prices in force when the order was made on the site www.rivecour.com and subject to availability.

Article 5

The confirmation of the order by the Client on the website www.rivecour.com means they will have accepted the General Terms and Conditions of Sale. When the order has been confirmed, the invoice is sent to the email address indicated by the client during the ordering process, or her/his registration on the website. In the event of a typing error of the Client’s email address, the Client will have 24 hours maximum to contact Customer Services to notify any errors and send the correct details. If this time limit is not respected, Rivecour cannot guarantee the modification will be taken into account.
However, Rivecour reserves the right to refuse all orders involving a dispute or incident with a Client regarding payment of a previous order, or justified by the present General Conditions of Sale.
Orders are confirmed by the “double-click” procedure. After having added the desired products to the shopping basket, the Client is then invited to confirm her/his selection before proceeding to the payment page on which all the necessary information regarding payment of the said price will be, and then she/he will be invited to confirm a second time. The information saved by the seller will constitute proof of its nature, the date and the content of the contract.

Article 6

The accepted payment methods are the following:

- Payment via Paypal. In this case, the Client is taken to the Paypal site in order to carry out the payment.
- Payment via Credit Card via Payplug, secured payment service: 3-D Secure

Article 7

Shipping costs vary depending on the different shipping methods chosen, all of which are available on the site www.rivecour.com
Shipping times indicated by our shipping companies are the following:

Shipping inside France
- Standard (via Colissimo): Delivery in 2 to 4 working days from the moment it is dispatched.

- Express (via Chronopost: Delivery in 24 hours for orders made before 12am from Monday to Friday.

International shipping

- International Colissimo: Delivery within 5 working days in Europe.
- DHL: Delivery within 8 working days worldwide.

All these shipping times are given for indication only. If the deadline is exceeded, it cannot be held against Rivecour, nor constitute a reason for terminating a contract or give cause for any kind of compensation.

We take tremendous care when preparing and sending the packages. However, we may have missed a defect. Therefore, as soon as the order is received, the Client will need to check the conformity of the product. If there is a discrepancy concerning the product or the delivery detected by the Client (product defect, damaged product, a missing part, damaged packaging), the latter should let Rivecour customer service know within 24 hours starting from the moment the Client received it. The Client may then be asked to send the damaged package back to Rivecour. As soon as the 24 hours are exceeded, Rivecour will not be liable.

Article 8

Even though we strive to offer high-quality products, a situation might occur where the Client may not be entirely satisfied with her/his order and wishes to return it in part or in its entirety. Rivecour insists upon total transparency with its Clients and would like to stipulate that the right of withdrawal is written in article L120-20 of the French Consumer Code. Article L120-20: “the consumer (here the Client) has a time limit of 7 days to exercise her/his right of withdrawal without needing a motive, nor to pay a penalty, apart from the delivery costs to return the package, if need be.”

The postmark or the date from which the package is available to be picked up constitute the date of the right of withdrawal, and if this limit is exceeded, any exchange or refund will be impossible. Any damaged products, returned incomplete or dirtied, will neither be exchanged nor reimbursed.

Rivecour can refuse to follow up on a claim made more than 6 months after the date of purchase, a claim relating to normal wear and tear, a defect for which you are responsible for or if it is an imperfection due to the nature of the product (some products may have small irregularities and/or roughness inherent in the materials used)

Article 9

In order to deal with the orders efficiently, giving your personal details is necessary. This personal information will only be used by Rivecour who commits herein to never share them with a third party, apart from external service providers who need this information for shipping. This information will be integrated into a confidential Rivecour file. In accordance with the Data Protection Act of 6th January 1978, the Client has access rights, modification rights, and rights to delete her/his own personal information. If the Client wishes to exercise her/his right, she/he will need to write to Rivecour S.A.S, 6 rue Seveste, 75018 Paris, France, indicating her/his name and address.

In the event of disputes, French Courts will be the only ones competent in dealing with such issues.
